Introduktion och personuppgiftsansvar

Skanska AB och bolag inom samma koncern (”Skanska”, ”vi”, ”vår”, ”oss” eller gemensamt ”Skanskakoncernen”) använder rekryteringsverktyget Jobylon (”Systemet”) för rekrytering och för att erbjuda arbetstillfällen.

I denna informationstext förklarar vi hur dina personuppgifter behandlas i samband med din registrering i Systemet och vår efterföljande behandling för rekryteringsändamål. Det är viktigt för oss att du känner dig trygg i att vi behandlar dina personuppgifter med största försiktighet. Vi uppmuntrar dig att ta dig tid att läsa denna informationstext noggrant.

Respektive bolag inom Skanskakoncernen har sitt eget System och sin egen kandidatdatabas. För tydlighets skull gäller denna information oavsett vilket bolag inom Skanskakoncernen du söker jobb.

Det bolag inom Skanskakoncernen hos vilket du söker anställning eller registrerar din profil är personuppgiftsansvarig och därmed ansvarig för behandlingen av dina personuppgifter.

Vilka uppgifter vi behandlar och var vi hämtat dem

Vi behandlar de uppgifter du anger i samband med din registrering i Systemet alternativt genom s k sourcing eller vid tips där våra rekryterare lägger in dina uppgifter i Systemet. Under rekryteringsprocessen samlas ytterligare uppgifter in i samband med intervjuer, tester och referenstagning samt från offentliga register och sociala medier.

Uppgifterna behandlas av Skanska i syfte att:

1. genomföra rekrytering för viss tjänst;
2. upprätta och upprätthålla vår kandidatdatabas;
3. gå igenom den information du har angivit i samband med tillsättning av andra tjänster som vi bedömer kan vara lämpliga för dig;
4. kontakta dig i syfte att uppdatera eller komplettera dina personuppgifter;
5. kontakta dig för att erbjuda tjänster vi tror du kan vara intresserad av;
6. kontakta dig för att efter 24 månader erbjuda dig att lämna ditt samtycke till att stå kvar i Systemet;
7. verifiera din information mot offentliga databaser/register (för vissa särskilda tjänster), t.ex. för att utreda om du är en person i politiskt utsatt ställning; samt
8. anonymisering och/eller aggregering för användning för statistiska ändamål.

Laglig grund för vår behandling av dina uppgifter

Dina uppgifter behandlas, enligt beskrivningen ovan, utifrån så kallad intresseavvägning. Intresseavvägning innebär att vi bedömer att vi har ett berättigat intresse av en effektiv rekryteringsprocess (både för den tjänst du har sökt och andra tjänster) och för tillvaratagande av våra legala rättigheter.

Strax föregående det att du varit registrerad i Systemet under 24 månader kommer vi kontakta dig för att inhämta eventuellt samtycke för ytterligare behandling, vilket därefter kommer utgöra den lagliga grunden för behandlingen.

Automatiserat beslutsfattande

Observera att vissa tjänster kan omfattas av specifika krav. En tjänst kan exempelvis kräva att du har rätt att arbeta i det land där du har ansökt eller att du har en viss examen eller liknande. Vi kan be dig att bekräfta att du uppfyller sådana krav genom att ställa en ja/nej-fråga. Om du svarar nej på denna fråga kan din ansökan komma att avvisas automatiskt. Du har alltid rätt att ifrågasätta automatiserade beslut, om du anser att de är felaktiga, genom att kontakta oss enligt kontaktinformationen nedan.

Du kan också bli föremål för automatiserat beslutsfattande utifrån den information du angivit då vi söker i Systemet efter kandidater för tjänst vilken fordrar viss utbildning, arbetslivserfarenhet, språkkunskaper eller andra krav. Uppfyller du inte dessa krav kommer du inte förekomma i urvalet.

Radering av personuppgifter

Dina uppgifter raderas automatiskt 24 månader efter det att du registrerats i Systemet.

Om du vill stå kvar i vår kandidatdatabas efter det att sökt tjänst tillsatts eller vid ansökan som inte avser specifik tjänst, kommer Skanska ge dig möjligheten att samtycka till detta efter att ovan angiven period löpt ut. Du kan när som helst återkalla detta samtycke och begära att dina uppgifter raderas.

Du kan närsomhelst själv välja att dölja dina personuppgifter. Om du gör det så kommer informationen på ditt konto vara dold och raderas 24 månader efter registrering. Om du vill att dina uppgifter raderas tidigare än så eller om du har frågor gällande radering av ditt konto kan du kontakta respektive ansvarigt bolag via kontaktinformationen nedan.

Under alla förhållande kan vi komma att spara dina uppgifter under en längre tid i syfte att kunna tillvarata Skanskas intressen vid eventuella rättsliga anspråk, t ex vid påstående om diskriminering, men bara så länge som sådana anspråk kan aktualiseras.

Utlämnande och överföring av uppgifter

Dina personuppgifter kan komma att delas med andra bolag i Skanskakoncernen för att bedöma om din profil passar andra tillgängliga tjänster. De kan även lämnas ut till parter som hjälper oss med vår behandling, till exempel rekryterare.

Eftersom Skanska är ett multinationellt företag kan dina personuppgifter undantagsvis komma att överföras mellan olika länder, inklusive länder utanför EU/EES. Dataöverföringar inom Skanskakoncernen regleras i ett internt avtal. Om vi överför dina uppgifter till externa företag utanför EU/EES säkerställer vi att lämpliga säkerhetsåtgärder har vidtagits, till exempel att EU-kommissionens standardavtalsklausuler för dataöverföringar ingår i våra avtal med de parter som får del av personuppgifterna.

Dina rättigheter i samband med vår behandling

I samband med behandlingen av dina personuppgifter har du följande rättigheter:

• Du har rätt att få information om dina personuppgifter behandlas och, om så är fallet, få tillgång till personuppgifterna (s.k. registerutdrag), med ytterligare information om behandlingen.
• Om du anser att dina personuppgifter är felaktiga eller ofullständiga har du rätt att begära att uppgifterna rättas.
• Under vissa omständigheter kan du begära att dina personuppgifter raderas eller att behandlingen begränsas.
• När behandling utförs med stöd av intresseavvägning (t.ex. informationsutskick) har du rätt att invända mot sådan behandling.
• Du har rätt att spärra användning av personuppgifter för direktmarknadsföringsändamål.
• Om du har lämnat samtycke till viss behandling, har du alltid rätt att återkalla ditt samtycke.
• På begäran har du även rätt, under vissa förutsättningar, att få ut och ta med dig vissa av dina personuppgifter till annan personuppgiftsansvarig, s.k. dataportabilitet.
• Du har rätt att framföra klagomål beträffande vår personuppgiftsbehandling till Integritetsskyddsmyndigheten (www.imy.se).

Information om Skanskas personuppgiftsbehandling i samband med rekrytering

Introduction and personal data responsibility

Skanska AB and entities within the same company group (“Skanska”, “we”, “our”, “us” or together the “Skanska Group”) use the recruitment tool Jobylon (the “System”) for the purpose of recruiting and offering job opportunities.

In this information text we explain how your personal data is processed in connection with your registration in the System and our additional processing for recruitment purposes. It is important to us that you feel confident with us processing your personal data with the utmost care. We encourage you to take the time to read this information thoroughly.

Each company within the Skanska Group has its own System and its own candidate database. For the sake of clarity, this information applies regardless of what company within the Skanska Group you apply for a job with.

The company within the Skanska Group with which you apply for employment, or register your profile, is the data controller and thus responsible for the processing of your personal data.

If you have any questions regarding the processing, please feel free to contact us. Contact information for the local personal data managers can be found at the bottom of this document and on each company's website.

What personal data we are processing and where we obtained it

We process the personal data that you provide us when registering in the System alternatively through so-called sourcing or through tips where our recruiters register your personal data in the System. During the recruiting process we collect additional information in connection with interviews, tests, and references as well as from public records and social media.

The information is processed by Skanska for the following purposes:

1. conduct recruitment for a specific position;
2. establish and maintain our candidate database;
3. review the information you have provided in connection with the appointment of other positions that we deem appropriate for you;
4. contact you for the purpose of updating or supplementing your personal information;
5. contact you to offer positions we think you may be interested in;
6. after 24 months, contact you to offer you to leave your consent to still remain registered in the System;
7. verify your information against public databases/registers (for certain specific positions), e.g., to find out if you are a person in a politically exposed position; and
8. anonymisation and/or aggregation for statistical purposes.

Legal basis for our processing of your personal data

Your personal data is processed, for the purposes mentioned above, based on a so-called balance of interests. The balancing of interest means that we consider us having a legitimate interest of an effective recruitment process (for the position for which you have applied as well as for other positions) and to protect our legal rights.

Prior to the point where you have been registered in the System for 24 months, we will contact you to obtain your consent for further processing, which will be the future legal basis for the processing.

Automated individual decision-making

Please note that some positions may be subject to certain requirements. A position may for an example require that you have the right to take up employment in the country where you have applied for a job, or that you have a certain degree. We may ask you to confirm whether you meet such requirements by asking a yes-or-no-question. If the answer to that question is no, your application may be rejected automatically. You are always entitled to reject to such automatized decisions, if you consider them wrong, by contact us via the contact information below.

You may also be subject to automated decision-making based on the information you provided when we are searching the System for candidates that meet certain requirements as certain education, work experience, languages etc. If you do not meet these requirements, you will not appear in the selection.

Deletion of personal data

Your personal data will be automatically deleted 24 months post registration in the System.

If you want to remain in our candidate database after that the announced position has been filled or if you do not apply for a certain position, Skanska will provide the opportunity to leave your consent for future processing after that the above-mentioned retention period has expired. You can at any time withdraw your consent and request the deletion of your personal data.

You can at any time choose to conceal your personal data. If you choose to do so, the information on your account will be hidden and deleted 24 months post registration. If you want your information deleted at an earlier time or have any questions regarding the deletion of your account, you may contact responsible company via the contact information below.

We may, under all circumstances, keep your information during a longer period for the purpose of protecting Skanska’s interests in case of legal claims, for example in case of claims regarding discrimination, but only during the time such claims can be actualized.

Disclosure and transfer of personal data

Your personal data may be shared with other companies within the Skanska Group to evaluate if your profile is suitable for other available positions. They may also be disclosed to parties that help us with our processing, for example recruiters.

Since Skanska is a multinational company, your personal data may in exceptional cases be transferred between countries, including countries outside of EU/EEA. Data transfers within the Skanska Group is regulated in an internal agreement. If we transfer your information to companies outside the EU/EEA, we will ensure that appropriate safety measures have been made, for example that the European Commission’s standard contractual clauses for data transfer is a part of our agreements with the parties that may access the personal data.

Your rights in conjunction with our processing

In conjunction with the processing of your personal data, you have the following rights:

• Right to access your data. You have the right to request a transcript of personal data processed by us, and additional information on how the data have been collected, processed, shared, etc. Right to rectification. You have the right to correct inaccurate or incomplete information about yourself.

• Right to erasure (“right to be forgotten”). You have the right to request that we delete personal data about you, for example if the data is no longer necessary in relation to the purposes for which it was collected or otherwise processed, or if there is no legal basis for processing the data.

• Right to restriction. You are entitled to request that the processing of your personal data should be limited until inaccurate or incomplete information about you has been corrected, or until an objection from you have been handled.

• Right to object. You have right to object to processing based on legitimate interest. This means that we may no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests. You can always contact us for more information on the balance test that has been made.

• You furthermore have an unconditional right to object to your personal data being processed for direct marketing purposes.

• Right to withdraw your consent. You may at any time withdraw any consent you have given us. However, please note that it will not affect any processing that has already taken place.

• Right to transfer your data. You have the right to transfer the personal data you have provided to us to another controller under certain conditions.

• Right to complain. You have the right to lodge a complaint to our lead supervisory authority or the supervisory authority in the country you live or work in if you believe that we have not complied with our obligations regarding your personal data.

In Sweden the supervisory authority is Integritetskyddsmyndigheten, which also is our lead supervisory authority, and you can find more information at their website, www.imy.se.
